MOFCOM Spokesperson’s Remarks on the U.S. Supreme Court’s Announcement of the Ruling in the Tariff Litigation Case

Q: On February 20, EST, the U.S. Supreme Court announced its ruling in the tariff litigation case, determining that the related duties such as reciprocal tariffs and fentanyl-related tariffs, and other tariffs imposed by the U.S. government on certain trading partners under the International Emergency Economic Powers Act (IEEPA) were unlawful. What is MOFCOM’s comment on this?

A: We have noted the U.S. Supreme Court’s announcement of the ruling in the tariff litigation case and are conducting a comprehensive assessment of the relevant content and implications. China has consistently opposed unilateral tariffs in all forms and has repeatedly stated that there are no winners in a trade war and that protectionism leads nowhere. The unilateral measures imposed by the U.S. side, including reciprocal tariffs and fentanyl-related tariffs, not only violate international trade and economic rules but also contravene the U.S. domestic law, and do not serve the interests of any party. It has been repeatedly proven that cooperation between China and the U.S. benefits both sides while confrontation harms both. China urges the U.S. side to cancel the relevant unilateral tariff measures imposed on its trading partners. We have also noted that the U.S. side is preparing to adopt alternative measures, such as trade investigations, in an attempt to maintain tariffs on its trading partners. China will closely follow these developments and firmly safeguard its own interests.
