Q: Recent developments in the consultations regarding the Nexperia issue have attracted significant attention. What is MOFCOM’s comment?
A: The Chinese side has previously responded to inquiries concerning Nexperia. I would like to reiterate that the Dutch government’s administrative order on September 30 constituted improper interference in Nexperia’s internal corporate affairs. Subsequently, the Dutch Amsterdam Court of Appeal’s Enterprise Chamber issued a wrongful ruling that deprived the Chinese company of its equity shares, severely infringing upon the Chinese enterprise’s legitimate rights and interests. Following this, the Dutch government ignored the Chinese side’s reasonable requirements in several rounds of consultations, and failed to demonstrate a constructive attitude nor take any concrete actions, but has instead exacerbated the global supply chain crisis. On October 26, Nexperia (Netherlands) announced to halt wafer supplies to Nexperia (China), obstructing the latter’s normal production and disrupting the global semiconductor industrial and supply chains. The Dutch side should bear full responsibility for this.
Acting responsibly for the stability and security of the global semiconductor industrial and supply chains, the Chinese side announced on November 1 that it would grant exemptions for eligible exports and is working to facilitate the resumption of supplies from Nexperia (China). However, the Dutch side insists on going the wrong way without taking concrete steps to resolve the issue, which will surely worsen the negative impact on the global semiconductor supply chain. This situation is not what China and the global semiconductor industry wish to see.
China hopes that the Netherlands will act responsibly and work with China towards the same direction, in the interests of overall China-Netherlands and China-EU economic and trade relations and the stability and security of industrial and supply chains, stop interfering in corporate internal affairs, and work towards a constructive resolution of the Nexperia issue. China will firmly safeguard the legitimate rights and interests of Chinese enterprises and strive to maintain a stable and smooth global semiconductor supply chain.
