MOFCOM BJT
A: China always opposes the EU’s abuse of unilateral tools such as the FSR to suppress Chinese companies. In May this year, in the Nuctech case, China issued its first prohibition order. Recently, in the http://JD.com case, the EU has unreasonably and extensively demanded a large amount of information from relevant banking institutions in China that is unrelated to the investigation.
In response, the relevant Chinese government authorities, following a thorough investigation and in accordance with the Rules of the People’s Republic of China on Counteracting Unjustified Extraterritorial Application of Foreign Legislation and Other Measures, have determined that the EU’s cross-border investigation practices against relevant Chinese entities in the FSR probe into http://JD.com constitute unjustified extraterritorial jurisdiction, and have ordered that no organization or individual may comply with or assist in implementing such measures.
I would like to emphasize that China and the EU have established the Trade and Investment Consultations (TIC) Mechanism and reached consensus on managing differences through dialogue and consultation. We hope the EU will work with China in the same direction, promptly correct its wrongful practices in the FSR investigation, and strengthen intergovernmental dialogue. China will closely follow the EU’s moves and take necessary measures to resolutely safeguard national security and the legitimate rights and interests of Chinese enterprises.
