On May 30, 2003, in accordance with Anti-dumping Regulations of People’s Republic of China, Ministry of Commerce issued an announcement to start anti-dumping investigation on imported Chloroform originating from EU, ROK, US and India. During the investigation, Ministry of Commerce signed a Price Commitment Protocol with 5 companies, including Vulcan Materials Company, which took effect as of November 30, 2004. As mentioned in Announcement No.53, 2005 of Ministry of Commerce, the rights and obligations of Chloroform Price Commitment Protocol could be transferred from Vulcan Materials Company to Basic Chemicals Company, LLC.

Recently, Occidental Chemical Corporation submitted to Ministry of Commerce an application, basing on the incorporation between Occidental Chemical Corporation and Basic Chemicals Company, LLC, applying for inheriting the rights and obligations of Chloroform Price Commitment Protocol from Basic Chemicals Company, LLC.

After examination, Ministry of Commerce cognized that the rights and obligations of Chloroform Price Commitment Protocol could be transferred from Basic Chemicals Company, LLC to Occidental Chemical Corporation as of June 22, 2007. Occidental Chemical Corporation shall implement the Price Commitment Protocol, while Basic Chemicals Company, LLC shall, on the same day, adopt the anti-dumping duty rate for other US companies listed in Announcement No.81, 2004 of Ministry of Commerce.
