Notice on Confirming the Overseas Enterprises Of Raw Material Processing And Assembling, and making a supplementary procedure

The Commissions/Bureaus/Offices of Foreign Trade and Economic Cooperation of each Provincial, Autonomous Region, National Municipality and Solely-planned Municipality:

In order to actively develop the businesses of Overseas Raw Material Processing and Assembling, and increase the exportation, the Ministry of Foreign Trade and Economic Cooperation (MOFTEC) will confirm the overseas enterprises of raw material processing and assembling or making the supplementary procedure. For the enterprises which get the confirmation or supplementary procedure, they will enjoy related favorable policies in the Approval Certificate of the overseas enterprises of raw material processing and assembling formulated by the MOFTEC. Related items are listed as follows:

1 For the enterprises which were approved to invest overseas for raw material processing and assembling, and have achieved successful export, you are required to submit their materials to the MOFTEC for confirmation. The application materials include:

(1) the approval documents of overseas investment and the Approval Certificate of the overseas enterprises of raw material processing and assembling;

(2) Registration documents from the located country of the overseas enterprises;

(3) The evidentiary materials and related data that the overseas enterprises promoted the export of raw material and parts and components;

(4) The assets and businesses of the overseas enterprises (business accounts, the balance sheet and the statement of gains and losses of the previous year);

(5) The assets and businesses of the parent company (the exportation of previous year, business statistics, the balance sheet and the statement of gains and losses);

2 For the enterprises which have not received the approval of overseas investment for raw material processing and assembling, but have achieved successful export, they are obligated to check them, notify relevant policies to them, and then report their materials to the MOFTEC. The MOFTEC will supplement them the Approval Certificate of the overseas enterprises of raw material processing and assembling. The materials required for the supplementary procedure include:

(1) the general situation of the overseas enterprises;

(2) Registration documents of the overseas enterprises, their regulations, the jointly-funded contract, and the resumes of their principals;

(3) the balance sheet, the statement of gains and losses, the businesses of the overseas enterprises in the previous year;

(4) the evidentiary materials and related data that the overseas enterprises promoted the export of raw material and parts and components;

(5) The assets and businesses of the parent company (the statistics of import and export, the balance sheet, and the statement of gains and losses of three recent years).

The above materials are required to be report to the Development Department (Overseas Sector) of the MOFTEC before April 20th.
