MOFCOM Jointly with Other 4 Ministries Issue Circular to Regulate China's Auto Export

Ministry of Commerce, National Development and Reform Commission, General Administration of Customs, General Administration of Quality Supervision,Inspection and Quarantine of China and Certification and Accreditation Administration of China jointly issued circular to regulate China's auto export recently, which intends to exercise control on complete vehicle and export qualification management on auto manufacturing enterprises through export license.

The circular makes specific regulations of qualification on enterprises that apply for export license of whole car. Auto manufacturing enterprises should possess three qualifications: 1, listing in notification of auto manufacturing enterprises and products of National Development and Reform Commission; 2, having passed and holding China Compulsory Certification; 3, possessing service capacity with export auto possessing quantity and setting up relatively perfect service system in exporting market. Export enterprises (including export corporations of auto groups) should possess two qualifications: 1, obtain export authorization of auto manufacturing enterprises which can export auto, and export according to the authorization; 2, sign to jointly assume quality guarantee, service after sales and related legal responsibility with manufacturing enterprises.

The circular regulates that according to application of manufacturing enterprises, MOFCOM and other four ministries shall issue list of enterprises meeting qualification of applying export license every December and enforce starting from Jan 1. In order to transact steadily, the list of 2007 will be issued in Feb and start enforcement on Mar 1.

To carry out the contracts signed before issuing of the circular, it is regulated that the export contracts signed before Jan 15, 2007 by enterprise does not list, they can carry out before Aug 1, after recording at the authorities of commerce in its located provinces, autonomous regions, municipalities, cities under separate State plan and Xinjiang Production and Construction Corp.

The circular shall make a combination of export management system and industrial policy, start from production, expand IPR protection, encourage enterprises to run with creditable and lawful business, limit assembling products export and restrain short-termed export, so as to guarantee product quality, enhance service capacity after sales, further regulate China's auto export order and improve auto export increasing quality and efficiency.
