| Announcement No.52, 2007 of Ministry of Commerce, on Confirming that the CHDM Modified Copolyester Originated from South Korea Shall not Involved in the Investigated Commodities of Polyester Chips Anti-dumping Case |

The former Ministry of Foreign Trade and Economic Cooperation released announcement (No.3, 2003) (hereinafter referred to as Announcement No.3, 2003) deciding to impose anti-dumping duties on imported polyester chips originated from the South Korea and decided the scope of the investigated commodities and related tariff codes.
Recently, the SK Chemicals claims to Ministry of Commerce (hereinafter referred to as investigating authority) that the CHDM modified copolyester shall not be covered in the investigated commodities.
The investigating authority delivered related materials to the domestic applicant of the anti-dumping case, and solicited opinions and comments. Investigating authority didn’t get any comments from the domestic applicants within the time stipulated.
In accordance with related materials, the investigating authority believes that CHDM modified copolyester is obviously different from the investigated commodity described in Announcement No.3, 2003 in chemical component, physical characteristics, purposes and so on, which shall not constitute an act of competition with the investigated commodity.
Therefore, the investigating authority confirms that the imported CHDM modified copolyester originated from South Korea shall not be covered in the investigated commodities in Announcement No.3, 2003. The Customs shall no longer impose anti-dumping duties on CHDM modified copolyester as from Jun 22, 2007.
