MOFCOM and GACC Announcement No.40 of 2017 on Implementation of United Nations Security Council Resolution 2371

For the purpose of the implementation of the United Nations Security Council Resolution 2371, the following management measures are hereby taken for some products involved in the import-export trades with North Korea pursuant to the Foreign Trade Law of the People's Republic of China:

I. As from the implementation of the MOFCOM and GACC Announcement No.40 of 2017 on Implementation of United Nations Security Council Resolution 2371 (the "Announcement"), it is fully forbidden to import coal, iron, iron ore, lead, lead ore and aquatic and marine products from North Korea. The aforesaid goods which have been transported to any Chinese port before the date of implementation of the Announcement may be released. As from zero o'clock of September 5, no import formalities will be handled (including the goods with declaration already accepted by the customs but release formalities having not been handled yet). After that, the aforesaid products will be deemed as the goods with imports forbidden.

II. The aforesaid measures do not apply to the coal not originating in North Korea but transited via the Rason Port of North Korea as proved by the exporting country as per credible intelligence, provided that the exporting country shall notify the committee established by the United Nations Security Council as per the Resolution 1718 in advance. A Chinese enterprise which imports the coal not originating in North Korea via the Rason Port shall go through customs clearance formalities by the exporting country's materials of notification of the committee established by the United Nations Security Council as per the Resolution 1718.

III. Please see the appendix for details about the forbidden products.

This Announcement shall be executed as of August 15, 2017.
