MOFCOM Announcement No. 10 of 2017 on Making Expiry Review Investigation of Applicable Anti-dumping Measures against Imported Printing Paper Originated in EU, USA and Japan

On March 22, 2012, the Ministry of Commerce of the People’s Republic of China (hereinafter referred to as MOFCOM) issued Announcement No. 10 of 2012, deciding to levy anti-dumping duties against imported printing paper originated in EU, USA and Japan since March 23, 2012 for five years. On June 29, 2016, MOFCOM issued Announcement No. 25 of 2016, adjusting the anti-dumping duty rate for FUJIFILM (Europe) Co., Ltd. and FUJIFILM (USA) Co., Ltd.

On January 16, 2017, MOFCOM received application for expiry review of anti-dumping measures submitted by Lucky Film Co., Ltd. representing the printing paper industry in China. In accordance with Regulations of the People’s Republic of China on Anti-dumping, MOFCOM reviewed the qualifications of applicant, facts about investigated products and same-kind products of China, import of investigated products in the period of implementing anti-dumping measures, possibility of continued or recurred dumping, possibility of continued or recurred damage, and relevant evidence. Existing evidence has proved the applicant complies with Article 11, 13 and 17 in Regulations of the People’s Republic of China on Anti-dumping about industry and representation of the industry, thus qualified to make applications representing printing paper industry of China. The investigating authority believes the applicant’s propositions and the prima facie evidences submitted by it meet requirements for case-filing of expiry review.

In accordance with Article 48 in Regulations of the People’s Republic of China on Anti-dumping, MOFCOM decides to make expiry review investigation, since March 23, 2017, of applicable anti-dumping measures against imported printing paper originated in EU, USA and Japan. Relevant matters are hereby announced as follows

I.Continue to implement anti-dumping measures

As proposed by MOFCOM, the Customs Tariff Commission of the State Council decides to, in the period of making expiry review investigation of anti-dumping measures, continue to levy anti-dumping duties against imported printing paper originated in EU, USA and Japan in the scope and rate of taxation specified in the MOFCOM Announcement No. 10 of 2012 and Announcement No. 25 of 2016.

II.Period of review investigation

The period of anti-dumping review ranges between October 1, 2015 and September 30, 2016 with industry damage investigation period ranging between January 1, 2012 and September 30, 2016.

III.Scope of products in the review investigation

The scope of products in the review investigation refers to the scope of products applicable for anti-dumping measures specified in MOFCOM Announcement No. 10 of 2012 and Announcement No. 25 of 2016.

IV.Review contents

Contents in the review investigation are, if terminating anti-dumping measures against imported printing paper originated in EU, USA and Japan, will it lead to continued or recurred dumping and damage?

V.Participate in registration of investigation

In 20 days after the Announcement is issued, the interested parties can register in the MOFCOM Trade Remedy and Investigation Bureau to participate in the anti-dumping expiry review investigation. The interested parties participating in the investigation should provide basic information, quantity and sum of investigated products imported or exported to China in this case, quantity and sum of producing or selling the same-kind products and related information in accordance with Reference Format of Registering to Participate in Investigation, which can be downloaded from http://trb.mofcom.gov.cn, the website of MOFCOM Trade Remedy and Investigation Bureau.

The interested parties in this Announcement refer to individuals and organizations specified in Article 19 of Regulations of the People’s Republic of China on Anti-dumping.

VI.Consult public information

In the process of investigation, the interested parties can log onto the above-mentioned website and consult application submitted by the applicant, and public information of the case, or go to MOFCOM Trade Remedy Public Information Consulting Room (Tel: 0086-10-65197878) to search, read, transcribe and photocopy public information of the case.

VII.Comments on case-filing

If intending to make comments on the product scope, qualification of applicant, investigated country and other relevant issues in this investigation, the interested parties can submit the comments in the written form to MOFCOM Trade Remedy and Investigation Bureau in 20 days after the Announcement is issued.

VIII.Means of investigation

In accordance with Article 20 of Regulations of the People’s Republic of China on Anti-dumping, MOFCOM can reach the relevant interested parties in the form of questionnaire, sampling, hearing and site review to learn facts and make investigations.

To obtain information needed by the investigation, MOFCOM often issues questionnaires, in ten working days after the deadline of registration for investigation participation specified in the Announcement, to the importers or producers of foreign countries (regions), domestic producers and producers registered to respond. The interested parties registered to participate in the investigation can also download questionnaire on the above-mentioned website.

The other interested parties that have not registered to participate in the investigation can download directly on the above-mentioned website, or demand questionnaire from MOFCOM Trade Remedy and Investigation Bureau and fill in the questionnaire by following instructions.

All companies should submit the complete questioners with correct and all information demanded by the questionnaire within specified time.

IX.Submit and handle confidential information

If the information provided by the interested parties should be kept confidential, the interested parties should make confidentiality requirements to MOFCOM and explain the cause. At the same time, such interested parties should provide the non-confidential overview of confidential information. The non-confidential overview should include sufficient and meaningful information so that other interested parties have rational understanding of the confidential information.

X. Consequences of non-cooperation

In accordance with Article 21 of Regulations of the People’s Republic of China on Anti-dumping, when MOFCOM is making investigations, the interested parties should provide facts in an authentic and honest way while providing relevant information. If the interested parties fail to provide facts and information in an authentic and honest way, or fail to provide necessary information within specified period, or serious hamper investigations in other ways, MOFCOM can give ruling in accordance with the obtained facts and obtained best information.

XI.Investigation period

The investigation will start on March 23, 2017 and end by March 22, 2018.
