MOFCOM Announcement No. 9 of 2016 on the Preliminary Ruling of the Anti-dumping Investigations into Imports of Acrylic Fibers Originated in Japan, South Korea and Turkey

In accordance with the provisions of the Regulations of the People's Republic of China on Anti-dumping (hereinafter referred to as the "Anti-dumping Regulations"), on July 14, 2015, the Ministry of Commerce (hereinafter referred to as the “Investigation Authority”) issued Announcement No. 22 of 2015, deciding to initiate anti-dumping investigations into the imports of acrylic fibers originated in Japan, South Korea and Turkey.

The Investigation Authority carried out investigations into the existence of dumping and dumping margin and the injuries to the acrylic fiber industry of China by the Product under Investigation, the extent thereof and the causality between dumping and injury. According to findings of the investigations and Article 24 of the Anti-dumping Regulations, the Investigation Authority makes its preliminary ruling (See the Annex). Relevant matters are hereby announced as follows:

I. Preliminary ruling

It is preliminarily ruled by the Investigation Authority that, imports of acrylic fibers originated in Japan, South Korea and Turkey were involved in dumping and the acrylic fiber industry of China was materially injured, and there was causality between the dumping and the material injury.

II. Collection of security deposit

In accordance with Articles 28 and 29 of the Anti-dumping Regulations, the Investigation Authority decided to carry out a provisional anti-dumping measure by collection of security deposit. Since April 2, 2016, import operators, when importing acrylic fibers originated in Japan, South Korea and Turkey, shall pay corresponding security deposits to the Customs of the People’s Republic of China in light of dumping margin determined by this preliminary ruling.

The description of the Product under Investigation are as follows:

Scope of investigation: imports of acrylic fibers originated in Japan, South Korea and Turkey.
Name of products under investigation: polyacrylonitrile fiber or acrylic fiber.
Chemical formula:
R represents CN or other functional groups
Description: acrylic fiber is a kind of synthetic fiber formulated by copolymer with acrylonitrile as the main monomers and with no less than 85% (mass fraction) repetitive unit of acrylonitrile in its molecular chain; it is usually white in appearance (can also be dyed into other colors), curls, and it is fluffy with soft hand feels. It is exactly like wools with better thermal protection. It is also known as “synthetic wool”. Acrylic fiber has a small relative density and features good chemical stability (acid resistance, weak base resistance, oxidant and general organic solvent resistant), good light resistant, heat insulation, weathering resistance and mold and moth resistance. The acrylic fibers are usually classified into acrylic tows, acrylic staple fibers, and acrylic tops.

Main purposes: acrylic fibers, generally after being spun into yards through cotton or wool spinning, are mainly used in fields such as garments (such as hats, gloves, scarves, artificial furs, sweater and knitted sportswear), decoration (such as carpets and curtains), blankets, stuffed toys and outdoor uses (dust coats for vehicles and vessels).

The products are listed under tariff numbers of 55013000, 55033000 and 55063000 in the Customs Import and Export Tariff of the People’s Republic of China. The modacrylic (modified acryl fiber) under the tariff numbers mentioned above are not included in the scope of investigation.

Rates of deposit imposed on companies are as follows:

Japanese companies:
1. JAPAN EXLAN CO., LTD 17.8%
2. Mitsubishi Rayon Co., Ltd. 15.8%
3. Toray Industries, Inc. 16.9%
4. All others 17.8%

Korean companies:
1. TAEKWANG INDUSTRIAL CO., LTD. 6.1%
2. All others 6.1%

Turkish companies:
1. Aksa Akrilik Kimya Sanayii A.Ş. 10.7%
2. All others 10.7%

III. Methods of deposit collection

As of April 2, 2016, import operators shall, according to the dumping margin of each company as determined in this preliminary ruling, pay relevant deposits to the Customs of the People’s Republic of China when importing acrylic fibers originated in Japan, South Korea and Turkey. The deposit shall be levied by means of ad valorem on the basis of dutiable value authorized by the Customs, and the calculation formula is: Deposit = (dutiable value authorized by the Customs x rate of deposit) x (1 + rate of import value-added tax).

IV. Comments

All interested parties may, within 10 days as of the issuance of this Announcement, submit their written comments attached with relevant evidence to the Investigation Authority.
