MOFCOM Announcement No.6 of 2015 on Case-filing for Midterm Review on Anti-dumping Measures against Imports of Pyridine Originated in India

The Ministry of Commerce released Announcement No. 73 of 2013 on November 20, 2013, deciding to impose anti-dumping duties on imports of pyridine originated in India and Japan since November 21, 2013.

On December 12, 2014, Anhui Guoxing Biochemical Co., Ltd, Nanjing Red Sun Biochemistry Co., Ltd., Weifang Lvba Chemical Co., Ltd. and Vertellus Specialty Chemicals (Nantong) Co., Ltd (hereinafter referred to as “applicants of domestic industry”), submitted an application to the Ministry of Commerce, claiming that, the dumping margin of exports of pyridine by Jubilant Life Science Limited (hereinafter referred to Jubilant) to China was increased upon the final ruling, excessively beyond the anti-dumping duty rate determined in the final ruling, and requesting a mid-term review to be conducted on the dumping and dumping margin of the imports of pyridine originated in Jubilant applicable to the anti-dumping measures.

On December 16, 2014, Jubilant and its affiliated trading companies Jubilant Organosys (Shanghai) Ltd and Jubilant Life Science International Pvt Ltd. applied with the Ministry of Commerce, claiming that the normal value, export price and dumping margin of Jubilant had material changes and there were no needs to maintain the anti-dumping duties, and requesting a mid-term review to be conducted on the dumping and dumping margin for the anti-dumping measures applicable to Jubilant.

On December 22, 2014, the Ministry of Commerce notified the Embassy of India in China of receipt of application from applicants of domestic industry, and forwarded the public text of the application for mid-term review and the non-confidential summary of the confidential information to the Embassy.

On the same day, the Ministry of Commerce notified the domestic industry of receipt of the application from Jubilant, and forwarded the public text of the application for mid-term review and the non-confidential summary of the confidential information to the industry.

In accordance with Article 49 of Regulations of the People’s Republic of China on Anti-dumping and Provisional Rules on Midterm Review of Dumping and Dumping Margin, after an anti-dumping duty has taken effect and a reasonable period of times has elapsed, the Ministry of Commerce may, upon request by an interested party and on the basis of examination of the relevant evidence submitted by the interested party, conduct midterm review on dumping and dumping margin of relevant exporters and manufacturers.

The Ministry of Commerce, according to the provisions above, conducted the review on the qualification of both applicants, the export price of the products under investigation and the normal value. The Ministry of Commerce considered upon review that, initial evidence is proposed in the application of both applicants that the dumping margin is changed, complying with Article 49 of Regulations of the People’s Republic of China on Anti-dumping and Provisional Rules on Midterm Review of Dumping and Dumping Margin. The Ministry of Commerce decides to conduct a mid-term review of the dumping and dumping margin of the anti-dumping measures applicable to imports of pyridine originated in Indian Jubilant Life Science Ltd. since the date of this Announcement. Relevant matters on review are hereby announced as follows:

I. Scope of Products

The scope of products is the imports of pyridine originated in Indian Jubilant Life Science Ltd, the detailed description of which is the same as product description in MOFCOM Announcement No. 73. The products under investigation are described as follows:
Products under investigation: Pyridine; alias: azabenzon.

Physical and chemical properties: Pyridine is a kind of six membered heterocyclic compounds, i.e. a compound with a “hydrocarbon (CH)” in the benzene molecule. Pyridine is usually a kind of colorless or light yellow liquid with strong irritant smell and low toxicity that is inflammable and soluble in water and most organic solvents such as alcohol and ether.

Main uses: Pyridine is the basic material for pesticides containing pyridine ring and medical intermediate, and is an important material for daily use chemical, fodder, food additives and radial tires. In the fields of medicine and industry, it can also be used as special solvent. As a material for intermediate, it is widely used in farm chemicals such as insecticides, bactericide, herbicide, growth regulators for plants, raticide. It can be used for manufacturing paraquat, auacide and chlorpyrifos. In the field of medicine, it can be used for manufacturing antineoplastic, psychopathic medicine and other medicine.
The product is listed under tariff code: 29333100 in the Customs Import and Export Tariff of the People’s Republic of China.

II. Period and Scope of Review

(i) Period of review: the period for dumping investigation of the review is from January 1, 2014 to December 31, 2014.
(ii) Scope of review: the scope of the review is applicable for the anti-dumping duty rate against imports of pyridine originated in Indian Jubilant Life Science Limited.

III. Review Procedures

(i) Comments from interested party.
Any interested party may propose comments on the review in writing within 20 days upon publication of this Announcement and shall provide evidence accordingly.
(ii) Distribution of questionnaire
To obtain the information that it thinks necessary for investigation, the Ministry of Commerce will distribute questionnaires to relevant interested parties based on actual needs. The questionnaires can be downloaded from the column of “Case Updates” in the sub-web Trade Remedy and Investigation Bureau on the website of the Ministry of Commerce (http://trb.mofcom.gov.cn). Questionnaires completed shall be submitted within 37 days after receipt according to the requirements set out in questionnaires.
(iii) Hearing.
An interested party may apply in writing for hearing in accordance with Provisional Rules on Midterm Review of Dumping and Dumping Margin of the Ministry of Commerce, and the Ministry of Commerce may hold a hearing if it thinks it is necessary.
(iv) On-site investigation
The Ministry of Commerce will assign staff to relevant countries for on-site investigation (if necessary); any material provided by an interested party shall include declaration on acceptance of investigation; and before investigation, the Ministry of Commerce will inform relevant countries and enterprises in advance.

IV. Noncooperation

According to Article 21 of Regulations of the People's Republic of China on Anti-dumping, an interested party shall provide authentic information and relevant documentation to the Ministry of Commerce in the process of the investigation. In the event that any interested party does not provide authentic information and relevant documentation, or does not provide necessary information within a reasonable time-limit or significantly impedes the investigation in any other ways, the Ministry of Commerce may make determinations on the basis of the obtained facts and the best information available.
