MOFCOM Announcement No. 28 of 2013 on Renaming of ARKEMA

On November 30, 2004, Ministry of Commerce of the People’s Republic of China issued annual Announcement No. 81, deciding to carry out anti-dumping measures against imports of trichloromethane originated in the E.U., South Korea, the U.S. and India. And ARKEMA signed a price commitment agreement with Ministry of Commerce of the People’s Republic of China, which came into effect as of November 30, 2004.

On November 29, 2010, the Ministry of Commerce issued annual Announcement No. 87, deciding to continue the anti-dumping measures against imports of trichloromethane originated in the E.U., South Korea, and the U.S. for a period of four years starting from November 30, 2010.

Recently, ARKEMA filed an application to the Ministry of Commerce, indicating that its entire trichloromethane business was transferred to KEM ONE, and requesting that KEM ONE, as the successor of ARKEMA, fulfilled the rights and obligations under the trichloromethane price commitment agreement, and submitted relevant documents such as the minutes of board’s meeting of ARKEMA, the articles of associations of ARKEMA and KEM ONE, and industry and commerce registration certification, etc.

The Ministry of Commerce notified the original anti-dumping measures petitioners, i.e. Zhejiang Juhua Co., Ltd. and Shandong Jinling Chemical Co., Ltd. , of matters with respect to the foregoing application. Within the prescribed time, the petitioners did not express any objection to the matter concerning KEM ONE’s succeeding ARKEMA to fulfill the rights and obligations under the trichloromethane price commitment agreement.

Upon examination, the Ministry of Commerce decides that:

I. As of May 21, KEM ONE inherits the original rights and obligations of ARKEMA in the anti-dumping case against trichloromethane, and fulfills the Price Commitment Agreement between the Ministry of Commerce of the People’s Republic of China and France ATOFINA on Anti-dumping Measures against Trichloromethane (ATOFINA is the former name of ARKEMA).

II. As of May 21, the anti-dumping tax rate of 96% under “other E.U. companies” determined in Announcement No. 81 of 2004 of Ministry of Commerce of the People’s Republic of China shall apply to the products under investigation exported to China under the name of ARKEMA.
