Announcement No. 42 of 2012 of the Ministry of Commerce of the People’s Republic of China on Preliminary Ruling of the Anti-dumping Investigation against Ethylene Glycol Monobutyl Ether and Diethylene Glycol Monobutyl Ether Imports Originated from the U.S. and the EU

As prescribed in the Regulations of the People’s Republic of China on Anti-dumping (hereinafter referred to as the "Anti-dumping Regulations"), the Ministry of Commerce (hereinafter referred to as the "investigating authority"), released on November 18, 2011 a formal announcement on its decision to launch an anti-dumping investigation into Ethylene Glycol Monobutyl Ether and Diethylene Glycol Monobutyl Ether Imports originated from the U.S. and the EU (hereinafter referred to as the "investigated product"). Tariff line of the investigated product is 29094300 under Import and Export Tariffs of the People's Republic of China.

The investigating authority has investigated into the existence of dumping and the dumping margin, the existence of injury to China’s Ethylene Glycol Monobutyl Ether and Diethylene Glycol Monobutyl Ether Industry and the extent of the injury, and the causal relationship between the dumping and the injury. According to the investigation findings and Article 24 of the Anti-dumping Regulations, the investigating authority released a preliminary ruling (see Appendix) and made the announcement as follows:

1. Preliminary Ruling
After the preliminary investigation, the investigating authority ruled that dumping exists in the imported investigated product originated from the U.S. and the EU during the period of investigation, and there is material injury to China’s domestic Ethylene Glycol Monobutyl Ether and Diethylene Glycol Monobutyl Ether Industry, and that there is a causal link between the dumping and the material injury.

2. Levy of Deposit
As prescribed in Article 28 and Article 29 of the Anti-dumping Regulations, the investigating authority decided to conduct anti-dumping measures in the form of levying deposit. From July 28, 2012, importers shall place deposits to China Customs when importing such investigated products originated from the U.S. and the EU based on the dumping margin of each company as prescribed in this preliminary ruling.

Tariff line of the products for which deposits are levied is 29094300 under the Customs Import and Export Tariff of the People's Republic of China and the detailed descriptions of the products are as follows:

Physical and chemical characteristics:

Ethylene Glycol Monobutyl Ether: colorless transparent liquid; runs the risk of combustion in contact with open flame, high heat and oxidant; soluble in organic solvents such as water, ethanol, acetone and benzene; has low toxicity, can dissolve oil, natural resin, NC Nitroncellulose, etc.

Diethylene Glycol Monobutyl Ether:colorless transparent liquid with slight fragrance; runs the risk of combustion in contact with open flame, high heat and oxidant; soluble in organic solvents such as water, ethanol, acetone and benzene; has low toxicity; can dissolve oil, natural resin, NC Nitroncellulose, etc.

Main Usage: Ethylene Glycol Monobutyl Ether and Diethylene Glycol Monobutyl Ether are solvents widely applied in water-based paints and solvents of nitrocellulose, alkyd resin and maleic anhydride modified phenolic resin. They are usually used as paint, especially Nitrocellulose spraying paint, and are antifogging and anti-wrinkled and can improve the glossiness and flowability of the film. They can also be used as metal cleaning agent, paint remover, lubricating oil remover, auto engine detergent, dry cleaning solvent, epoxy resin solvent, drug extractant, pesticide dispersing agent, oil dispersing mutual solvents of printing ink, cutting oil and fiber oil. They are also used as solvents of nitrocellulose, varnish, printing ink, stamp ink, oil and resin, etc. as well as stabilizing agent of emulsion paint, evaporation suppressor of plane coating, surfacing improver of high temperature baking enamel.

EU Companies:

a) Sasol Germany GmbH

Sasol Solvents Germany GmbH 13.0%

b) INEOS Chemicals Lavera SAS 9.3%

c) BASF SE 18.8%

d) All others 14.9%

3. Methods of Levying Deposits

From July 28, 2012 Importers shall place related deposits to China Customs when importing such investigated products originated from the U.S. and the EU based on the dumping margin of each company as prescribed in this preliminary ruling. The deposits shall be levied by means of ad valorem on the basis of dutiable value authorized by Chinese Customs. The formula is: Deposit= (dutiable value authorized by Chinese Customs x deposit rate) x (1+ Import VAT rate).

4. Comments
Each interested party may submit to the investigating authority a written comment as appended with related evidence within 20 days from the date of issuing this Announcement and the investigating authority will consider in accordance with the laws and regulations.
