Announcement NO.12 of 2020 of Ministry of Commerce, General Administration of Customs and State Administration for Market Regulation on Reinforcing Quality Regulation on Exported Supplies for COVID-19 Response

At this special time when COVID-19 continues to spread around the globe, in order to support more effectively the collective response of the international community to the global public health crisis, measures on reinforcing quality regulation over supplies for COVID-19 response and ensuring orderly export are announced as follows:

I. Strengthened quality regulation over non-medical masks export. Starting April 26, non-medical masks to be exported shall meet Chinese or foreign quality standards.

The Ministry of Commerce (MOFCOM) provides a confirmed list of non-medical masks manufacturers with foreign standard certification or registration (to be updated continuously on the website of the China Chamber of Commerce for Import and Export of Medicines and Health Products, www.cccmhpie.org.cn), and the State Administration for Market Regulation (SAMR) provides a list of unqualified products and manufacturers of non-medical masks that have been investigated and punished in the domestic market (to be updated continuously on the website of the SAMR, www.samr.gov.cn). Non-medical masks exporters must submit an electronic or written version of the Joint Declaration of the Exporter and the Importer (Annex 1) for customs clearance to confirm that the products to be exported meet Chinese or foreign quality standards, and that the importers accept the quality standards of the products and will not use them for medical purposes. The General Administration of Customs of China (GACC) will inspect and release the products according to the list of manufacturers provided by MOFCOM; it will accept the customs declaration, inspect and release the products if the manufacturers are not on the list provided by SAMR.

An electronic or written version of the Joint Declaration of the Exporter and the Importer (Annex 1) must be submitted for the export customs declaration for purchase contracts signed before April 26.

II. Additional regulation on orderly medical supplies export. Starting April 26, exporters of coronavirus test kits, medical masks, protective gowns for medical use, ventilators and infrared thermometers with foreign standard certification or registration must submit an electronic or written declaration (Annex 2) for customs clearance to commit that their products meet the quality standards and safety requirements of the importing country or region. GACC will inspect and release the exports according to the list of manufacturers with foreign standard certification or registration (to be updated continuously on the website of the China Chamber of Commerce for Import and Export of Medicines and Health Products, www.cccmhpie.org.cn) provided by MOFCOM.

Aforementioned quality regulatory measures on exported supplies for COVID-19 response will be adjusted in light of the evolving pandemic.
