MOFCOM Announcement No. 24 of 2019 on Adjusting the Anti-dumping Duty Rates Applicable to Imports of Certain Alloy Steel Seamless Tubes and Pipes for High Temperature and Pressure Service Originating in the United States and European Union

MOFCOM released Announcement No. 34 of 2014 on May 9, 2014, and decided to impose the anti-dumping duties on imports of certain alloy steel seamless tubes and pipes for high temperature and pressure service originating in the United States and European Union for five years starting from May 10, 2014.

On June 15, 2018, in response to the application submitted to the Ministry of Commerce by the domestic industry of certain alloy steel seamless tubes and pipes for high temperature and pressure service, MOFCOM released Announcement No. 52 of 2018 and decided to carry out the interim review of the dumping and dumping margin for the anti-dumping measures applicable to imports of certain alloy steel seamless tubes and pipes for high temperature and pressure service originating in the United States and European Union. On May 9, 2019, MOFCOM released Announcement No. 20 of 2019 and decided to carry out expiry review investigation into the anti-dumping measures applicable to imports of certain alloy steel seamless tubes and pipes for high temperature and pressure service originating in the United States and European Union starting from May 10, 2019.

The products of the interim review investigation are certain alloy steel seamless tubes and pipes for high temperature and pressure service originating in the United States and European Union. The specific description of the products is consistent with the description of the products specified in MOFCOM Announcement No. 34 of 2014 and it is as follows:

Name of the products under investigation: 相关高温承压用合金钢无缝钢管, also called P92无缝钢管, 10Cr9MoW2VNbBN无缝钢管, X10CrWMoVNb9-2无缝钢管, etc.
English name: Certain Alloy-Steel Seamless Tubes and Pipes for High Temperature and Pressure Service.

Specific description: The tube or pipe diameter is 127 millimeters or longer. Among all the chemical components, the carbon (C) content (wt%) is greater than or equal to 0.07 and less than or equal to 0.13, the chrome (Cr) content is greater than or equal to 8.5 and less than or equal to 9.5, the molybdenum (Mo) content is greater than or equal to 0.3 and less than or equal to 0.6, and the tungsten (W) content is greater than or equal to 1.5 and less than or equal to 2.0. The tube or pipe is an alloy steel seamless tube or pipe with a tensile strength greater than or equal to 620 MPa and a yield strength greater than or equal to 440 MPa, irrespective of whether it has been further processed.

Main applications: Certain alloy steel seamless tubes and pipes for high temperature and pressure service are mainly used in supercritical and ultra-supercritical power station boilers and as power station steam and water tubes and pipes because they have good high-temperature strength and creep resistance.

The products are listed under tariff numbers of 73045110, 73045190, 73045910 and 73045990 in the Customs Import and Export Tariff of the People's Republic of China. The other products with the above tariff numbers that do not conform to the above specific description of the product under investigation do not belong to the products under investigation.

According to the investigation results, MOFCOM has suggested the implementation of the anti-dumping measures to the Customs Tariff Commission of the State Council. In accordance with Article 50 of the Anti-dumping Regulations of the People's Republic of China (hereinafter referred to as the Anti-dumping Regulations) and the decision of the Customs Tariff Commission of the State Council, MOFCOM now announce the relevant matters as follows:

I. Review ruling

MOFCOM has ruled that the dumping of imports of certain alloy steel seamless tubes and pipes for high temperature and pressure service originating in the United States and European Union existed during the review investigation period.

II. Anti-dumping measures

In accordance with the relevant provisions of the Anti-dumping Regulations and the decision of the Customs Tariff Commission of the State Council, MOFCOM has decided to impose anti-dumping duties on imports of certain alloy steel seamless tubes and pipes for high temperature and pressure service originating in the United States and European Union starting from June 14, 2019.

III. Methods of levying anti-dumping duties

As of June 14, 2019, when an import operator imports certain alloy steel seamless tubes and pipes for high temperature and pressure service originating in the United States and European Union, the operator shall pay the corresponding anti-dumping duty to the Customs of the People’s Republic of China. The anti-dumping duty shall be levied by means of ad valorem on the basis of the dutiable value authorized by China Customs, and the calculation formula is: amount of anti-dumping duty = dutiable value authorized by China Customs * rate of anti-dumping duty. The import value-added tax shall be levied by means of ad valorem with the dutiable value authorized by China Customs plus the tariff and anti-dumping duty as the taxable value.

IV. Administrative reconsideration and administrative litigation

According to Article 53 of the Anti-dumping Regulations, any person or organization that refuses to accept the review may apply for administrative reconsideration or initiate litigation to a people's court according to the law.

V. The announcement shall be implemented as of June 14, 2019.
