MOFCOM Announcement No. 49 of 2016 on Preliminary Ruling on Anti-dumping Investigation against Imports of Distiller's Dried Grains with or without Solubles Originated in the U.S.

In accordance with the Anti-Dumping Regulations of the People's Republic of China (hereinafter referred to as the "Anti-dumping Regulations"), on January 12, 2016, the Ministry of Commerce (hereinafter referred to as the “Investigation Authority”) issued the Announcement No. 2 of 2016, deciding to initiate anti-dumping investigations into the imports of distiller's dried grains with or without solubles originated in the U.S. The Investigation Authority has implemented investigations into the existence of dumping and dumping margin and the injury to the distiller's dried grains with or without solubles industry of China by the Product under Investigation, the extent thereof and the causality between dumping and injury. According to findings of the investigations and Article 24 of the Anti-dumping Regulations, the Investigation Authority makes its preliminary ruling. Relevant matters are hereby announced as follows:

I. Preliminary ruling

It is preliminarily ruled by the Investigation Authority that, the imports of distiller's dried grains with or without solubles originated in the U.S. were involved in dumping and the relevant industry of China was materially injured, and there was causality between the dumping and material injury.

II. Collection of security deposit

In accordance with Articles 28 and 29 of the Anti-dumping Regulations, the Investigation Authority decided to take a provisional anti-dumping measure by collection of security deposit. Since September 23, 2016, the import operators, when importing the Products under Investigation, shall pay corresponding security deposits to the Customs of the People’s Republic of China in light of dumping margin of each company determined by this preliminary ruling.

Description of the products under investigation:
Investigation Scope: Imports of distiller's dried grains with or without solubles originated in the U.S.
Name of the products under Investigation: 干玉米酒糟,又称干谷物酒糟、干酒精糟
Name in English: Distiller's Dried Grains with or without Solubles.
Description: Distiller's dried grains with or without solubles are alcohol lees and dried residual liquid obtained after the processing of fermented liquid in the course of alcohol (ethanol) production by way of fermentation from such raw materials as corn and other grains, regardless of whether they contain soluble protein substances or not.

Main usage: Formula will be prescribed from distiller's dried grains with or without solubles and other nutrients for feeding poultry, livestock, aquatic products and special animals.

The product is listed under tariff number of 23033000 in the Customs Import and Export Tariff of the People's Republic of China.

III. Methods of Deposit Collection

As of September 23, 2016, import operators shall, according to the dumping margin (see Annex 2) of each company as determined in this preliminary ruling, pay relevant deposits to the Customs of the People’s Republic of China when importing the distiller's dried grains with or without solubles originated in the U.S. The deposits shall be levied by means of ad valorem on the basis of dutiable value authorized by the China Customs, and the formula is: Deposit = (dutiable value authorized by the Customs x rate of deposit) x (1 + rate of import value-added tax).

IV. Comments

Any interested party may, within 10 days as of the date of release hereof, submit written comments to the Investigation Authority.
