MOFCOM announced the preliminary ruling on the countervailing probe into wine imports originating from Australia

On December 10, MOFCOM issued Notice No.58 of 2020, announcing the preliminary ruling of the countervailing investigation against wines originating from Australia. The ruling found that subsidies existed on imported wines originating from Australia, that the domestic wine industry in China was materially damaged, and that there was a causal relationship between the subsidies and the material damage. MOFCOM has decided to impose temporary countervailing measures on the above products in the form of a temporary countervailing duty deposit of 6.3% to 6.4% for each company from December 11, 2020.

Upon the application of the domestic wine industry, MOFCOM issued a notice on August 31, 2020, deciding to initiate a countervailing investigation into the import of the relevant wines originating from Australia. After the filing of the case, MOFCOM conducted the investigation in strict accordance with relevant Chinese laws and regulations and WTO rules and made the aforementioned preliminary ruling.
