MOFCOM Trade Remedy and Investigation Bureau Wang Hejun Comments on the U.S.’ Preliminary Ruling of the Anti-dumping Investigation against China’s Aluminum Foil

On October 27 in Washington, the U.S. Department of Commerce announced its preliminary ruling of the anti-dumping investigation against China’s aluminum foil. Director of MOFCOM Trade Remedy and Investigation Bureau Wang Hejun made a statement on this.

Wang pointed out that the 15th article of the Protocol on China's accession to the WTO about the anti-dumping "surrogate country" expired on December 11, 2016, and all WTO member should abandon the use of "surrogate country" in the anti-dumping investigations and ruling against China from then on. The US was supposed to obey the international obligations and determine whether the Chinese products were dumped based on the sales price of its domestic enterprises. However, in this case, the US has disregarded the WTO rules and refused to fulfill its international obligations by continuing to use the discriminatory way of "surrogate country", ruling the high tax rate of 96.81%-162.24%. China expresses strong dissatisfaction with this.

Wang stressed that this will not only damage the Chinese enterprises’ interests but also the seriousness and authority of the multilateral rules. China urges the US to meet its international obligations and take practical actions to correct its wrongdoings. China will adopt necessary measures to safeguard the legitimate rights of Chinese enterprises and reserve related rights under the WTO dispute settlement mechanism.
