Official with Department of Treaty and Law of Ministry of Commerce Comments on WTO’s Panel Report on China’s Appeal against U.S. Countervailing Measures

The World Trade Organization (WTO) announced a panel report on China’s appeal against U.S. countervailing measures on July 14.

An official with the Department of Treaty and Law of the Chinese Ministry of Commerce commented on this case. He said that the panel group supported China’s appeals and ruled that U.S. countervailing measures against China in public organization recognition, land specificity requirements and exports restrictive measures violated WTO rules. China welcomed its ruling in this respect.

The official said this case covered 22 kinds of products, with an annual export value of US$7.2 billion, concerning China’s major trade interests. China urged the U.S. side to respect the WTO’s ruling, stop the abuse of trade remedy measures as soon as possible and ensure the environment of fair competition for Chinese businesses.

The official said that the panel group ruled that adverse facts available, calculation of subsidized interest and subsidy specificity requirements used by the U.S. during the period of countervailing investigation do not violate WTO rules. China felt sorry for that.

The official expressed that China is evaluating the panel report and will do the follow-up work in accordance with WTO dispute settlement procedures.
