Ladies and gentlemen, I appreciate this opportunity to exchange views with you on the Regulations for the Implementation of the Labor Contract Law of the PRC. Please first allow me to give you an overview on the implementation of the LCL. It is known for a fact that the LCL is an important piece of domestic legislation for building labor relationships in the new stage. It bears great significance and far-reaching implications for further rationalizing the labor contract system, defining the rights and obligations of both parties to a labor contract, protecting the legitimate rights and interests of workers, promoting sustainable business and fostering a harmonious employer-employee relationship. Since the LCL was promulgated and put into effect, labor authorities at various levels have made efforts in implementation as required by law. To increase public knowledge and application of the law, labor departments at different levels have distributed nearly 20 million handouts and trained more than 2 million professionals across a wide range of industries. By dipping into the LCL, employees have become more active in protecting rights according to law and employers more conscious in learning and abiding by the law. Thanks to all-rounded efforts, we have made initial progress on the implementation of the new law, which can be summarized as “two ups and one down”. The first up refers to the increase in the number of labor contracts signed. According to statistics from 26 provinces, autonomous regions and municipalities, in the first half of this year, 90% to 96% employees had entered into labor contracts with their employers, 3 to 8 percentage points higher compared with the end of 2007. The second up is in the insured population and the collection of insurance contributions. From January to June this year, the numbers of employees enrolled with pension, unemployment, medical, work-related injury and maternity insurance had increased by 7.7, 3.65, 8.75, 8.52, and 6.77 million as compared with the end of last year. The total nationwide revenues from these five types of insurance amounted to 610.5 billion RMB, 31% higher than the same period last year. The one down refers to the drop in the number of short-term labor contracts. Generally speaking, the number of labor contracts with a term less than a year has decreased dramatically, in contrast to a substantial rise in the numbers of labor contracts with a term of 3 to 5 years and of open-ended contracts. Having said that, we have noted the public has brought to our attention many suggestions and comments on the further implementation of the law. In particular, there has been a strong voice and demand for making the law more enforceable. For next step, we will closely monitor the progress on and issues arising from the implementation of the LCL and its Implementation Regulations, and work even harder to ensure satisfactory implementation.
