Chong Quan: US Anti-Dumping Determination on Wooden Bedroom Furniture from China was Unfair

On Nov. 9 and Dec. 10 in 2004, US department of Commerce and International Trade Commission made final determinations respectively on anti-dumping case of Wooden Bedroom Furniture imported from China, confirming dumping and material injury to US domestic industry.

Chong Quan, spokesman of MOFCOM, said that US determination was unfair to Chinese enterprises. USA did not grant Market Economy Treatment to China-produced furniture but still adopt usual practice of surrogate country principle in the case, which was not in accordance with reality and against US international obligation so that US party judged higher anti-dumping duty. Besides, most of relative enterprises in China were granted lower anti-dumping duty in the final determination through active echo to antidumping sue, but some Chinese enterprises in Wooden Bedroom Furniture were considered arbitrarily not to cooperate with USA and were arbitrated to be levied higher duty. Meanwhile, China thought "Jury" put forward by application was mainly attributed to the fact that it could not adapt to domestic competition caused by capital, production and sales instead of Chinese products. US determination was against the fact, therefore, China's government expressed strong dissatisfaction.

Chong Quan said that China notice that the determination was criticized intensively in USA. Which completely indicated that the determination not only would be disadvantageous to US consumers but also could not meet the target of boosting domestic industries and was not beneficial for US macro economy.

Chong Quan pointed out that China hoped US government acknowledge achievements of market economy made by China and change their unfair treatment to Chinese enterprises at an early date, promote healthy development of bilateral trade on the basis of fair and nondiscrimination.
