| MOFCOM Spokesman Commenting on US Decision to File an Anti-subsidy Investigation on Chinese Coated Free Sheet Paper |

At 5 pm on Nov. 21, 2006, an official from the Embassy of the United States of America in China circulated a notice to the head of the Bureau of Fair Trade for Imports and Exports of Chinese Ministry of Commerce that US Department of Commerce decided to file an anti-subsidy investigation on coated free sheet paper imported from China on Nov. 20 (New York Times). MOFCOM Spokesman Chong Quan commented on US decision and pointed out that Chinese side expressed regret over the decision by the US on anti-subsidy investigation on coated free sheet paper imported from China. Decision of US side was not in accordance with relative WTO rules and against related laws and regulations of the US. The US side maintained defining China as a non-market economy country in spite of the huge achievements of market economy reform made by China in the past 20 years. On one hand, US side took discrimination actions of subrogation country in the anti-dumping investigation on Chinese export products, and on the other hand, launched anti-subsidy investigation on Chinese products, forming double discrimination against Chinese products. Chinese side provided a large amount of facts and legal evidence to the US side, proving that the anti-subsidy appeal had no sufficient conditions for filing a case, under such circumstances, US Department of Commerce was determined to place the case on file, which was not only against WTO rules but also the consensus reached by the two sides to eliminate disagreements through negotiation. Chinese side attached great importance to the negative influence caused by US decision and would pursue closely after the issue and reserve all rights to safeguard China's legal rights and interests.
