 国家发展和改革委员会近日发布公告，就《反价格垄断规定（征求意见稿）》向社会公开征求意见。这份征求意见稿涉及我国境内和境外的价格垄断行为。 发展改革委公告指出，为预防和制止价格垄断行为，保护公平竞争，维护消费者利益和社会公共利益，依据《中华人民共和国反垄断法》，发展改革委起草了《反价格垄断规定（征求意见稿）》。为充分听取各方意见，现就征求意见稿网上征求意见，欢迎社会各界提出修改意见和建议。有关意见和建议的反馈截止日期为2009年9月6日。 发展改革委在其网站上公布的征求意见稿规定，“中华人民共和国境内经济活动中的价格垄断行为，适用本规定；中华人民共和国境外的价格垄断行为，对境内市场竞争产生排除、限制影响的，适用本规定。” 根据征求意见稿，价格垄断行为包括价格垄断协议；滥用市场支配地位的价格垄断行为。行政机关和法律、法规授权的具有管理公共事务职能的组织，滥用行政权力，在价格方面排除、限制竞争的行为，也适用《反价格垄断规定（征求意见稿）》。 《反价格垄断规定（征求意见稿）》共29条，约4000字。 |
