Circular of the General Office of the State Council of the People’s Republic of China, on Sorting out and Regulating Various Activities Related to Occupational Qualifications

People’s governments of all provinces, autonomous regions and municipalities, ministries, commissions and organs directly under the administration of the State Council:
The professional qualification system is an important policy to evaluate talent in the socialist market economy. This policy has improved step by step in recent years and played an important role in enhancing the qualification of professional and vocational workers and enforcing the training of talented people. Meanwhile, some evident problems also exist in the practice of the policy. Approved by the State Council, the work of sorting out and regulating various activities related to the professional qualification shall be carried out recently. The relevant issues are now promulgated:

1. Principle and scope of the work of sorting and regulating
(1). Principle of the work of sorting and regulating. To persist in taking the scientific concept of development as the general principle and taking the scientific concept of talent as the guide; To persist in integrating the work of sorting out, regulating and managing according to the law with the improvement of reform and the principle of orderly development. To persist in unified leadership, the principle of separation of functions, the principle of classified management and the principle of step-by-step implementation.
(2). Scope of the work of sorting and regulating. Professional qualification and related exams and certificate-issuing activities set or organized by departments, organs, institutions directly under the administration of the State Council and the subdivisions, or departments, organs, institutions directly under the administration of the local governments, or associations of various trades and academies, or enterprises.

2. Content of the work of sorting and regulating
(1). To sort out and regulate the setting of professional qualification.
(2). To sort out and regulate the professional qualification exams and appraisal.
(3). To sort out and regulate printing and issuing of the professional qualification certificates.
(4). To sort out and regulate the professional qualification training and the related charges.
(5). To reform and improve the professional qualification certificate system.

3. Methods and steps of the work of sorting and regulating
(1). All departments of the State Council, the people’s governments of all provinces, autonomous regions and municipal cities shall earnestly organize the work of sorting and regulation on the setting, exam, appraisal, training, charges and certificate-issuing of various professional qualifications within the limits of their powers in their internal systems and respective administrative areas. The work of sorting and regulating on professional qualification and related activities set or organized by the associations of various trades or academies shall be finished before April 30 of 2008.
(2). The personnel department and labor security department of the State Council shall summarize the work reported by departments of the State Council, the people’s governments of all provinces, autonomous regions and municipal cities and deal with the work earnestly with the related department, and promulgate the name, setting basis, variety of the professional qualification approved and executive departments and institutions to the public by stages and by batches. Meanwhile, the unapproved professional qualification exams and related certificate-issuing activities shall not be carried out.

4. Requirements on the work of sorting and regulating
(1). To strengthen the organizational leadership.
(2). To define the duties and responsibilities clearly.
(3). To implement the work actively and steadily.
