| Circular of the Ministry of Commerce of the People's Republic of China, on Delegating the Relevant Work of Examining and Approving of Foreign Investment Enterprises in Some Service Trade Areas to Changsha Economic and Technological Development Zones |

The people’s government of Hunan Province, the people’s government of Changsha and Changsha economic and technical development zone: In accordance with spirit of Document of General Office of the State Council on Transferring Several Opinions of Ministry of Commerce, Ministry of Land and Resources and Ministry of Construction on Further Promoting Development of State-level Economic and Technical Development Zone (No.15, 2005) and regulations of Ministry of Commerce on delegating the work of examining and approving foreign-invested enterprises, Ministry of Commerce has completed the work of registration and examination and approval of administration system of state-level economic and technical development zone and network system of foreign investment examination and approval. Related issues are now announced as follows： 1. For purpose of encouraging and supporting state-level economic and technical development zone to make great efforts to advance high value-added service industry, Ministry of Commerce hereby entrust entrusting Changsha Economic and Technical Development Zone with work of examining and administrating foreign-invested enterprises in service and trade industry that are established in the development zone. 2. Changsha Economic and Technical Development Zone shall, in accordance with laws and regulations of foreign investment and related regulations on foreign-invested non-vessel carriage, construction, printing, design of construction engineering, transportation, commerce, international cargo transportation (refer to appendix), strictly check and earnestly examine and approving related foreign-invested enterprises established in the development zone. If encounter any problem, they shall report to Ministry of Commerce in time. Ministry of Commerce will examine the entrusted work of examination and administration, and will terminating the commission to the state-level economic and technical development zones that go against regulations of examination and approval. 3. The administration committee of Changsha Economic and Technical Development Zone shall strictly follow the requirements of Ministry of Commerce network annual examination and online united annual examination, and use the network certificate issuing system of foreign-invested enterprises to finish the work of examination and approval, registration and statistics as well. Related data of statistics shall conform to requirements so as to facilitate Ministry of Commerce to enhance administration and supervision. 4. Changsha Economic and Technical Development Zone shall keep effective and simple administration system, and promote working level of foreign-invested enterprises examination and administration. If the administration system causes negative effect on foreign-invested enterprises examination and administration, Ministry of Commerce will take back entrusted authorities of examination and approving immediately. 5. This circular shall take effect as from release.
