Announcement No.77, 2007 of the Ministry of Commerce of the People's Republic of China

In accordance with Article 48 of Anti-dumping Regulations of People’s Republic of China, the time-limit of anti-dumping imposition shall not be longer than 5 years and the time-limit of anti-dumping duty imposition could be properly prolonged if the termination of anti-dumping duty imposition might cause continuance or reoccurrence of dumping and injuries.

As from the promulgation of this Announcement, the domestic industries, nature person or legal person of domestic industries or related organizations could apply for an expiry review in written forms when 60 days ahead of the termination of the relevant anti-dumping measures. The application shall include sufficient evidence that the termination of anti-dumping duty imposition might cause continuance or reoccurrence of dumping and injuries.

If the domestic industries, nature person or legal person of domestic industries or related organizations failed to raise a written petition for an expiry review in accordance with this Announcement, or the Ministry of Commerce have no initiative expiry review before the termination of anti-dumping measures, the original anti-dumping measures shall be terminated as from the expiration date.
