Circular of Ministry of Commerce and State Administration of Industry and Commerce on Related Matters on Registration and Management of the International Freightage Agency

Commercial administrative departments and bureau of industry and commerce administration in all provinces, autonomous regions, municipalities and separately listed cities, and Shenzhen bureau of communications:

The State Council’s Decision No.16, 2004 on Canceling and Adjusting the Administration Examination and Approval of the Third Batch of Projects canceled operation qualification examination and approval of the international freightage agency. For the implementation of the cancellation of operation qualification examination, enforcing the follow-up work of supervision and management and guaranteeing the health development of China’s international freightage agency industry, related matters are now announced as follows:

I. After canceling the agent operation qualification examination and approval of the international freightage, commercial administrative departments will no longer examine and approve qualifications of the enterprises when they apply for international freightage agent business. Applicants may directly register at the local administrative departments of industry and commerce; those not registered cannot operate relevant business.
II. Administrative departments of industry and commerce should strictly follow item No.8 of the Administrative Regulations on International Freightage Agency Industry of PRC (approved by the State Council and promulgated by the previous Ministry of Foreign Trade and Economic Cooperation Decree No.5, 1995. “Regulations” for short in the following) on registered capital of international freightage agent business of the sea, aerial flight as well as land way. The words of “international freightage” should be added in the name of the enterprises that take international freightage as their main business; in principle, business scope of enterprises should be checked and ratified in accordance with “international freightage agent business of…”, and if necessary, item No.17 of the Regulation may be followed for specific checking and ratifying. For those that should be examined and approved by relevant administrative departments in accordance with regulations of related law and administrative law, approval documents of relevant administrative departments should be submitted as well. After canceling examination and approval of operation qualification, registered enterprises should be standardized with above requirements.
III. Commercial administrative departments should take responsibility to actively develop and explore administrative modes and measures of the international freightage agency industry, enhancing criterion and administration of the industry. In addition, commercial administrative departments should support work of guilds and take full advantage of guilds in administration, strengthening self-discipline, regulating operation as well as protecting the lawful rights and interests of members of guilds.
IV. Commercial administrative departments and administrative departments of industry and commerce at all levels should enhance communication and coordination, earnestly fulfill obligations and administer by law, support operations by law and encourage fair competition, and combat illegal operations for the purpose of further regulating the market order of the international freightage agency and promoting the development of the China’s foreign trade.
