MOFCOM Responded to ECJ’s Final Judgment in EU’s Glyphosate Anti-dumping Case against Chinese Chemical Company

On 19 July, the EU Court of Justice (ECJ) released its final judgment in the glyphosate anti-dumping case against Chinese chemical company Zhejiang Xinan Chemical Industrial Group Co. Ltd (Xinanchem). ECJ ruled that EU’s anti-dumping measures on Xinanchem invalid, and dismissed the EU Council’s appeal entirely. The Chinese enterprise got the final victory of the case.

The Head of Bureau of Fair Trade for Imports and Exports of MOFCOM said in an interview that, in recent years, in order to safeguard their own interests, Chinese enterprises sued EU for the unfair anti-dumping measure with ECJ to question the wrong doings of the EU investigation authorities, and won over in many cases. EC has always been misusing the discretion and improperly using the applicable law in trade remedy investigations, which lead to a deviation in the principle when using trade remedy measures. We learnt that EC is to file a case independently to launch trade remedy investigations. China holds the view that, as an important member of the WTO, EU should strictly abide by WTO rules and avoid misusing trade remedy measures and disturbing normal China-EU bilateral trade.
